Best IP Protection is Through Education, Not More Enforcement Actions
Introduction
It is beyond dispute that China has some of the most comprehensive and up-to-date Intellectual Property (IP) protection laws of any country in the modern world, in conformance with its accession to the Berne Convention and the Geneva Convention.1 This is a direct result of China’s serious fourteen-year pursuit of World Trade Organization membership and compliance with its WTO obligations.2
On October 27, 2001, China promulgated the amendment to its PRC, Copyright Law of 1990 (the Copyright Law). The amendment came into effect upon its promulgation. The purpose of this amendment was to bring China’s copyright protection to full compliance with relevant international conventions. It seems more than coincidental that the amendment was promulgated one week before China signed its WTO accession documents; the amendment was issued in all likelihood to prove that China is making efforts to honour its WTO commitments.”3
China acknowledges that its own IT sector is retarded due to lack of transfer of foreign technology and lack of foreign investment, both caused by lack of foreigners’ belief in IP protection in China.4 China has ratcheted up IP enforcement with record numbers of prosecutions in all provinces and semi-autonomous regions, because China sees this as being in its own economic best interests. Yet, organizations like AmCham assert that while such enforcement actions are laudable, they fall far short and suggest that the situation is getting worse, not better.5 The Asia-Pacific Council of American Chambers of Commerce asserts, “Aggressive enforcement of intellectual property rights will benefit both consumers and businesses. Encouraging the enforcement of IPR rights will allow U.S. companies to reap the benefits of their investments, and will also encourage additional businesses, particularly small- and medium-sized enterprises, to participate in the global marketplace.”6
This myopic world-view taken from a “business only” perspective ignores the most fundamental principles of Globalization, cultural diversity appreciation and understanding. For five thousand years the Chinese have had no concept of private intellectual property rights. Under the Emperor Dynasties and more recently the Socialist Economic System, the government owns all real and personal property, including celebrity endorsements.7
1.3 billion people cannot be expected to embrace such a foreign concept over night. IP protection is brand new (last 20 years) and the basic change in recognizing private ownership of IP is hard to teach and hard to accept. Only 53 percent of the people even speak Mandarin8 and more than 8.72 percent are illiterate.9 That is one-hundred thirteen million illiterates in China. An entire society needs to be taught about the value of private ownership of intellectual property. This educational process must begin at China’s universities where libraries allow and even encourage wholesale copying of entire books.
Under the socialist economic system the government owned the books (copyrights were non-existent) and the people are the government. So, the people copy what they already own and thus are not stealing anything from anyone. This practice continues to this day. Chinese libraries still allow this practice to continue unabated without even a cursory check to see if the book has an ISBN number.The Chinese universities are the Research and Development labs for China and yet 75 percent of them fail to patent their own inventions.10 India is as adept at copying China’s non-patented pharmaceuticals as China is at copying America’s copyrighted DVDs.11
Chinese people understand that it is wrong to steal tangible goods but there is no concept that taking IP without compensation is wrong. Intangible thoughts and ideas have no reality as something that is subject to theft, even when they are reduced to a writing or artwork. On any given day, in any given Chinese bookstore, there are more people sitting on the bare floor stealing IP (reading books for free) than patrons in the local library. Even the bookstores encourage IP theft. There are no signs prohibiting free reading and no enforcement of such a “foreign” idea. The people know that they cannot take the book out of the store without paying for it, but they do not understand that their act of reading it without compensation also constitutes a theft. A major Shanghai university teaches IP protection using a Prentice Hall book, copied in violation of the copyright laws. This university has a teacher stand in front of the class and teach that it is wrong to steal IP while teaching from a stolen textbook. This is hypocritical and sends the wrong message to the students who are the next generation of business and government leaders. The universities must teach, not just preach, IP protection and they must implement what they teach. China’s universities are teaching the next generation of political and business leaders, as well as the next generation of teachers. Education is the fundamental key to change, not enhanced enforcement actions.
Increasing IP enforcement actions tenfold will not accomplish the desired transformation of Chinese thinking and attitude towards IP ownership and protection. This can only be accomplished through proper education, not hypocritical half-hearted educational efforts. It is no easy task to bring such fundamental change to the thinking of 1.3 billion Chinese people. It requires a psychological revolution of unprecedented proportions to create a new ethos where none has existed before. Enforcement actions undoubtedly have an effect on those successfully prosecuted but to assume a deterrent effect that will sweep throughout China’s society is to continue to believe that capital punishment deters murder or other serious crimes.

Nowadays, intellectual protection is increasingly pushed on the calendar. Obviously, people in various lines of work such as economists and sociologists and so on all expressed enormous interesting on this hot issue. Yet we have to admit there is a great step to stride at present in order to implement intellectual protection in action.
In the current society of China, some people maybe regard that the intellectual protection is a double-edged sword. That is simple to conceive because if we protect individual IP we cannot to do many things such as reading free books from library and downloading songs from internet. What’s more, we could not buy those bargains which copy from certified products. How foolish it is, indeed, if we pursue intellectual protection in shooting speed we will bear some risks and endure a great loss at present, however, if we assume in a far way, we will be paid for a brilliant future, moreover, we will establish trust and credit in the international society again.
By the way, how can we take the intellectual protection into action? I think the fundamental point is to vary the view of people. Most people ignore the intellectual protection, and the reason is that they don’t know their behaviors are illegal, and this process is not immediately putted into practice. We should be careful and much patient for the reformation, then, we should highlight the importance of education so as to improve people’s sense. Through proper education, not the hypocritical half-hearted education we can change our minds for IP gradually. Only in this way can our country develop more strong and have a splendid future.
There is so many IPR problems in china, especially in town. Make my hometown for example, there are so many middle or small company don’t care the Trademark much. How to make the people to know the importance of that is a big problem. Here is some of my opinion.
We should let them know the law, so the first thing we have to do is to teach them the law. To organize lessons to some middle or small businessman. Maybe they are deeply know the business rule of the market, but they don’t treat as a juridical person before. So after the lesson, we should let them to log their trademark in the administrative department of industry and commerce. The government should give some interests to them, like duty reduction, or provide them some help from technology. Only these can encourage them put attention on the law, but it’s not the key point. If you have problem that it will cost much, but you should know that there are so many companies which doesn’t log in the government in the town. After the buffer period, government should carry out the law seriously. Maybe some corps will be replaced, but the market will be more orderly. And the government can help some companies that is potential to go out. I think it will at least need 3 years to realize the target. But it help much to create the market economic.
It’s only my immature opinion, hope it can work.
Aim at the situation of “IP Protection” of China in this years, I think that there are some methods to solve the problem:
1. Put the “IP Protection” into economic law and other relative laws and implement with a firm hand.
2. With the develop of economy, business demand “IP Protection” a fortiori. Our governmen should establish a section to administer “IP Protection” in the filiation of economic deparment.
3. Teach students at junior or senior high school that make more and more people know about “IP Protection”.
4. Use the media like newspaper and TV to popularize the concept of “IP Protection”.
We need do much to protect IP.
First, the government should set up a sound legal system for IP.
Second, we should enforce the law strictly.
Third, promulgate the important of IP.
I think only we have the corresponding law and enforce the law. We can punish the corresponding action. Then, more and more people will aware that what is IP, which action is wrong and the important of protecting IP. But we need a long time to do this. And maybe many people can’t understand about it at the beginning time. So we must enforce the law strictly and promulgate the important of IP. Only in this way, we can protect IP. I know that t is difficult to do everything. But if we don’t take action, there will be no good art, no good book, and no good music in the future. Our country economy will be affected by this.
I do believe Chinese government will take some actions to carry out the IP protection law someday,but in current situation I don’t think it is appropriate to do so now.I agree with Martin and also I’ve seen my schoolmates’ suggestions on how to strengthen our awareness and how to punish the IP “thief”.Well,let’s imagine:from now on I can’t download any music or movies from the website freely,I can’t read any novels freely because that is all illegal.If I have enough money to pay for each of them,that’s easy,no problem.But what I am concerned is that:to the citizens who are very poor,they just can make a simplest living,how can they afford their culture life?If they want to watch a movie,they can go nowhere but only the cinema,but you know the price.If the government can do a package deal,I mean China already has the ability to provide her people the resource to share fairly,regardless the poor or the rich,is it still a problem?China still has a long way to go judging by its current economic situation.We all know IP protection is a hard task to be achieved,but before we take actions,we first must make sure how to charge the fee so that everyone can share the resource fairly.I really don’t want to see some people who may have no chance to enjoy something because of lacking of extra money.To the rich,anything is easy to get by paying the price,but to the poor,how can they get that?I do know nothing in this world is free,but what I am more concerned about is the world is making a big progress besides making profit.
Honestly,I have not realized the phenomena of IP violation is so serious from the companies to the schools in China.Maybe the original reason of that is the traditional thinking of Chinese people.Although the government has made a lot of measures to promote the IP protection,it is still a long way to go.China is a developing country and of vast territory.As we know,there are different cultures and different economic levels among the 56 nations.What can we do to let the large number of people to be aware of the importance of IP right?The answer is definely education. Because the enforcements only address the symptoms, not the cause. In my opinion,we should not only establish the laws but also expand the influence of education.Just like popularizeing the related knowledge of IP through the advertisements in the media and classes in the school.All the policies are aiming to give the masses the message that protect IP then protect your country.We students should also obey the laws and tell others around us the importance of IP protection.It is our responsibility to make efforts to help our motherland develop more quickly.
I never thought we are guilty when we download the music from Internet before I attend the oral English class yesterday. But in China billions of people lack of the awareness of IP protection like me and the problem of IP protection has slow down our country’s economic development. In order to solve it, the most important thing to do is publicizing the knowledge of IP protection especially among the younger generation. Schools should educate the students to respect others’ creativity and protect our IP right from being harmed. But there will still be some people continue this kind of action. So our country should improve its IP protection system, including amending its intellectual property laws, strengthening its enforcement practices and normalizing the market orders. The rights of people inventing some creative ideas should be ensured and those stealing others’ achievement should be punished heavily. I believe our mother country will make impressive progress in IP protection and attract more foreign investment.
Intellectual Property protection is a serious problem for our country ,but I think protect IP is not only the government job,but also common citizens.So I think government and citizens should pay attention to IP protection,and there are several solutions to resolve it.firstly,government should lay down the law for IP protection,and our country can learn experiences of IP protection with other countrys,in addition,our government should improve our education about IP protection.Secondly,everybody should attach importance to IP protection as other treasures preserve.
Today in our life, IP became more and more important. We all know that no work no development ,no create no progress. I know a story about IP. In my little sister’s high school, there is a teacher who teach politics. When he study here, once his mentor ask him to write a thesis, then he finished the thesis and hand in his homework to his mentor. The mentor said it is so bad. At the beginning he think his thesis is really bad, but he found his thesis was published in a magazine after some time. And the author is his mentor. So he is very angry, then he leaved his school. He think he is only a student but his mentor is a professor, so no one would believe him.
This phenomenon is not the unique, and IP is not perfect in China. Maybe we will meet this case, so we should strengthen the protection of the law and protection awareness. The best protection of IP is through education.
If I am the advisor to the CCP.I would suggest the Government enact specific laws to protect intellectual property. This is a more effective method in the short term.But the most useful way is to educate.
Education will let us understand what conduct is a violation for intellectual property.Such as download the music for the internet for free.Childhood education is very important.If we know the importance of intellectual property protection when we was a children.It will form a environment for intellectual property protection naturally.Although we may spend a long time to wait the results,I still think this is the most effective way.
As science and technology is developing rapidly,the protection of IP has drawn wide attention of Chinese.Although the Chinese government has tried to improve the level of IP protection ,there are still some shorttages we must face.In my opinion,we can make advencement by two ways— lawmaking and education.
For resolving the problem of bribe, the Chinese government legislate a new law what cognizance not only the person who receive bribe,but also who deliver bribe for favors or influence are culpable several years ago,and it had received good effect.So I think for solving the problem of Ip protection,we also can make a new law to cognizance the action of using others’IP without payment is illlegal,not only the action of making money by using others’IP without payment.
Education will be another effective way.As we known,most of key personlities in the future society are coming from present students.If the school education can raise the IP protection awareness of students,it means they will raise the IP protection awareness of all the future society.
In my opinion, we should first make the students know the IPR through teaching them the knowledge about IPR. The project is not only last 1 year or 2 years, but to from Grade 1 to post graduate year by year. They are the major and the future of china, this can make the law have planted in their heart, and it will set an example for all the Chinese.
The administrate should completely the law, and it should be executed well. What’s more, it should help the companies to go to the right way, but it doesn’t mean that the administrate should protect them, just the other way, it must give some strict punishment once they brake the law. But it should help the companies to know the law, and help them to catch IPR of the international development.
The specialist of IPR is the important comportment of the law. Administrate should cultivate many lawyers of the IPR so that it will push the IPR to an fast developmental way. We cannot go to trip without shoes. That is to say that the administrate should encourage any industries about the IPR to develop. One of the targets is to make people pay attention on it. And the more people know it, it will develop well.
It is beyong dipute that situation of IP protection in China is bad, even worse, which I think would do a lot of harm to China herself even she has a most comprehensive and up-to-date laws about IP protection. The reason for this situation maybe complex. One cannot simply say it is somebody or some goverment’s fault. In the past 30 years, we’ve done a lot in order to meet the needs of developing a socialist market economy and expedite China’s entry into world economy. However, we have a long way to go with 1.3 billion Chinese people who are still mostly impressed by old traditional things or struggled their lives in morden world. IP protection is necessary, but it needs time and great effort of all our Chinese.
Since the reform and opening policy, China has accelerated the process of establishing an IPR protection system in order to rapidly develop the social productive forces. But IPR protection system still has some defects. Here are my plans to perfect it.
In China, some 5 years old children have already know how to use computer. They down load network resources for free and don’t feel guilty of their behavior because their parents do in this way. So I think, we should offer a class to the little children on IPR in a simple and easy way, in order to let them know at an early age that we should respect other persons’ innovation, and don’t copy from others. Education on IPR should be offered in college, too.
We should launch a television program about IPR on CCTV, for CCTV is the most famous television channel in China. In this way, huge amounts of people, especially the businessman who has the greatest potential to break the IP law in their business life, in China will know more about IPR protection, then, it will be easier for the government to administer the IP law.
We should also set up a legal organization to enforce IP law and make it perfect according the development of our society, that is to say, to ensure IP law advancing with the times.
We should have faith in that under the efforts of all comrades in China, IP law will become much more perfect, and more and more new things will emerge under the protection of IP law.
As we know that the IP protection should be taken seriously. But how can we do to protect it?
We should aware that there would be at least two sides of the IP protection. One is for the individual and another for the society.
So that my plan to solve the problem can be concluded as follows:
Firstly as the owner of the intellectual property, one should learn to know how to protect yourself and protect your property. Keep the evidence to proof you are the owner of the IP.
Secondly the society should do a lot of things to protect it, including the university education, social communication also should be done to let most people get to know something about IP.
The government plays an important role to make sure that private property should be protect well. In order to accomplish those things, the legal system improving is indispensable. The punishment also should be done when the crime happens.
Though these things may cost a long time to achieve, we should be patient for that.
That’s my personal opinions about IP protection.
One country’s level of protection of intellectual property rights, but also a manifestation of the country’s comprehensive national strength.Currently, China’s IP protection work remains to be improved, personally believe that you can improve it from the following aspects .
First, strengthening the national quality improvement, which start with primary school students‘ education, educate every person who is surffing education to respect other people’s essence of wisdom.
Secondly, strengthening the individual’s awareness of IP protection , which should be acted on every citizen .
Finally, improving our laws so that to protect more people’s intellectual property rights are not be violated.

Frankly speaking, everyone knows that IP is important, and it’s wrong to steal others’ achievement. But if you want to change this situation in china in a short period, it’s, I think, impossible. China is a development country. Compare with west countries and Japan, China doesn’t have many resources to pay for the copyright and patent. Maybe you will feel it’s unbelievable. But the fact is, to a country that many people still live a hard live, how you should ask the people to pay something that seems has nothing to do with them. Of course, this situation would change, but not today or tomorrow. Only when the economic becomes better and people needn’t to work for a simple live, can people pay more attention to the IP. And at that time, the IP protection wouldn’t be a problem any more.
It’s known that the phenomenon of stealing intellectual property is very common in our country, and we can see lots of piracy DVD, VCD, pirated copy books and so on everywhere. Although china amended its IP-related laws and regulations to conform with WTO requirements, changes in the level of IP protection have been an evolving process. In my opinion, I think the most important part to resolve the issue is to improve people’s awareness of IP, for many people ignore IP even never know the concept of IP, according this we can take measures form several angles, one, for the education, teachers should teach students about IP. Two, for the government, it can point the importance of protecting IP and step up propaganda efforts through media, such as TV, newspapers. Another important part to resolve the issue I think is to regulate the market, which mainly is regulated by the government, it can draw up a series of laws to regulate those who steel IP, of course, as citizens who clearly know IP, we also should restrict ourselves not to buy anything of illegal copy. And I believe as long as everyone strives as much as possible, the status of IP will be well.
IP protection is really a new concept to Chinese people.In our daily life,we just read copys of original editions,buy pirated copies and pirate versions of software,and also see a movie from download websit.All these things we are used to is the violation to IP protection.After discussion in our class yesterday,I felt very ashamed about IP protection.I think we should do more to help our government to standardizing the IP market.

Intellectual property right piracy in China effectively destroys the creative initiative of Chinese inventors and scientists. It also hurt the bilateral relations with many countries. Therefore, IP protection is becoming the most challenging and significant issue.
What can we do to solve the problem? In my opinion, we should provide an environment which is safe for intellectual property right. It can be divided into three parts: market, punishment and education. Let me explain the first part with an example. In 1998, a piece of win98-cd was sold for 1998rmb. At that time, ordinary earn about 500 hundred a month. They have to eat, pay the rent and so on. And there are many copies sold 5rmb a piece. It is not difficult for most people to make the choice. When the price is up high in an unacceptable way, stealing happens. If we reduced 1998 to 50 or so and provided more service than the pirates do, maybe they will lose the market and disappear because it is unprofitable. And this won’t need any police or law. The second part is punishment. When the cost of infringing is very low, people won’t be afraid to break the law. Years ago, the punishment of traffic violation is up to seven years in prison even if you drive after drinking and kill five people. But lately a man who droved after drinking and killed five people is sentenced to death. By now, the drinking problem has been under control. It seems to be effective to increase the punishment. For the last part, better education should be provided to let the citizens, not only the students, know about the laws of IP protection. People are not stopping breaking the law when they don’t even know they are breaking it. Establishing such environment above may do a little help to IP protection.
As we all know, IP stems from the exercise of the mind and is unique and original and have marketplace value, Thus, for the interests of innovators, IP enjoys legal protection. Meanwhile, IP protection is also the need of society as well as individual.
In my view, something should be done to guarantee IP protection .First, some relative laws should be set up or improved so that those who disobey or violated would have a harsh punishment. Secondly, proper education is a key factors .Increasing IP enforcement actions tenfold can only be accomplished through proper education, not through the transformation of thinking and attitude towards IP ownership and protection. Education can raise the awareness of IP protection. Last but not least, co-operation efforts are needed to improve IP protection.
I firmly believe things will be better, so is IP protection.
During the class discussion,I was shocked that so many student took it for granted that downloading music,video and so on for free on Internet is legal.In our neighbour city Hongkong,the government had already forbidden the download software like BT(bittorrent,a kind of P2P download software),and the music download cannot be free.
So,too many people know little about the IP protection.So here is the first suggestion:The IP protect concept should be gernally educated.For example,we can set up a certain compulsory course about IP protection in senior school or junior school so that the teenagers will get the IP protection concept.
Second,most of us have PC,and almost everyone’s operating system is “Windows”.The price of this software is about 2000 yuan, nearly a middle class’s one-month salary.If we take “Office”,”Photoshop” and so on software into account,it can be a huge cost for a person.So here I recommend that these software companies may publish a special version that is not so expensive for Chinese users.
The third one is that,there are so many exellent textbooks we can’t get in China.So if we have to read it,we have no choice but only to get the photocopy.So the government may encourage the chinese publishers to publish these books.
The last but the most important is,the IP protection law should be completed.
In my opinion ,there are two ways to make things better.
1.to make people believe money is the only thing one can trust in and dream of;money is the only thing one can make from work and life;money is the only way one can get happiness .
2.to let the people know one can make a furtune over night
and then I believe everyone in china,would never forget the importance of IP as Amercians do .may be even children can speak IP out
Nowadays, intellectual property protection, as a social issue, has been attracted more and more attentions in the world, especially in the developed areas. While, considering the complicated realities of China, consciousness of protecting intellectual property are not strong on the whole, particularly little consciousness in the areas that are sharply short of education. AS we all know, intellectual property, as sweetest fruit resulting from hard working of the owners, such as creating a wonderful idea, must be very difficult to gain and cost a great deal of time, energy or money. It is the honor, status and lots of money that the owners of intellectual property should get naturally. However, if someone gets it free of charge and takes gaining freely into account, or even steals it for keeping himself, it may have worse influence with the owners and society. What is more, it is a virtue to respect intellectual property rights, no getting something for free without permitting and keeping other’s intellectual property. Accordingly, education concerning intellectual property protection should be popularized on a large scale all over our China. The government should take measures to help solve it, however, enforcement actions can not be a wise way to solve the problem, because there is a saying going that the more enforcement actions, the worse effect. It is the education that must be a best way to solve the problem, if time and energy permitting. AS a college student, we are meant to take the responsibility for intellectual property protection, just trying our best.
Intellectual Property (IP) protection，a new expressing in my mind. During the oral class ,we have a discussion on it after seeing the movie “the working girl”. And Doctor Martin asked us some questions and told us something about the Intellectual Property (IP) protection in our country and other countries, then he let us to think about some ways to change the situation of our country now. So, after class, I thought something about the question. There is no the best way not only to protect the Intellectual Property but also to provide the common knowledge and interesting things to people. However, in order to protect the right of people who creative the things and ways, we should make some efforts, such as making out laws and by using them in charge, and on the other hand, the owners should sign their names on the raw thoughts to avoid others stealing their ideas. But, as the teacher said in the class, In our mind, Intellectual Property (IP) protection is so week. So I think, the most important thing is to educate our children in each possible way when they are young. But, on some extent, we should have something for free, or paid less money for it, then they can be understand by more and more people.
IP protection is a big problem in some countries including China. If it is ignored, the privileges of the creators can not be protected and gradually there will be less and less people who would like to contribute their ideas. But how to solve this problem is another tough problem. As in China, since she became a member of WTO, she has established some laws on this issue. However, it’s not easy to make them work because the large population with relatively low GNP adds difficulties. As far as I’m concerned, to better the situation, we have to pay attention to three parts. Firstly，higher economy level is necessary. If people own sufficient extra money，they will pay more on legal products. Secondly, education is a key point to make a change. Now many people lack awareness that buying illegal products is harmful. To alter the root thought on IP protection, we should tell the young generation right opinions and when they grow up, they will not do it again. Thirdly, Laws and rules should be strengthened and completed.
The IP protection was so important that the government should take measures to lead to a general recognition that IP should be well protected in our country. First, students, especially the ones in universities, must be taught the importance of the IP protection and how to protect IP. Because they may be the most creative person in the country and they are more teachable. Second, the government should seriousluy punish the person or organization who infringe IPR, such as the website providing free downloads of songs and movies. Third, the government should encourage the society to protect IP. Many people in society prefer copies of books and illegal downloadings just because the copies is not as expensive as the original ones and the illegal downloadings even charge nothing. In this case, the government can pay partly for the IP which will result in a lower price of a original book and a legal DVD. A lower price will be a great encouragement for people to protect IP. The expenses which the government pay for the IP will be paid by the people gradually when there is a strong recognition of IP protection in the society. We can not change the 1.4 billion people in one night, the path that lead to perfect IP protection is long but still there always an end.
Patent, designs and trademark are known as Intellectual property .IP has become a motive force, In addition to an enabling role , in advancing invention and innovation and industrial development world-wide .IP protection is a serious problem that need solving carefully . IP not only refers to individuals , but also refers some companies, the society and even some countries . IP protection is of great urgency .
Education plays a important role in solving this problem. China’s universities should teach the next generation of political and business leaders , as well as the next generation of teacher .Education is the fundamental key to change, not enhanced enforcement action .At the same time, our country should set up a more comprehensive law system to protect IP. We have a long way to go on the IP protection.
As time goes by, IP protection problems are urgent for each country, especially for China to solve. Because China is a developing country. Moreover, a lot of IP problems are needed to consider. Nowdays, not many people in China understand IP problems. If not enough efforts are made by China to solve IP problems, China will lack of foreigners’ belief in IP protection, which will lead to China’s backwardness.
In order to solve IP problems, in my opinion, from the subjective side, knowledge derives from education. Universities in China should teach students to respect the value of private ownership of intellectual property and encourge them to protect IP. From the objective side, the owner of intellectual property could take measures such as applying for a patent and copyright to protect IP. If intellectual property rights have been violated, they could take legal weapons to protect their own interests.
With the high-speed development of internet, China faces more challenges on IP protection. Although IP protection is gaining more and more attention now, tort is still a common phenomenon in China. So, in my opinion, we should make it as follows:
1 Strengthen legal efforts to IP protection. There are already dozens of rules and regulations on it, but the tort doesn’t disappear. So, the severe punishment is needed. Consider that, if a person just copied only one book, and is imposed a fine of one hundred times the price, will more people do this afterward?
2 The general public supervision should take effect on IP production. People could be encouraged and rewarded to disclosing the tort. So everyone is the police of IP protection.
1. The government should make the network more standardized. The release of movies, songs and other things violating the copyright should be banned or at least controlled. Free movies and songs are quite a temptation that keep us away from the department store.
2. It should be acknowledged what IP exactly means to the public. Just as the artcle said, education is more important than enforcement actions. It will be a long process, but should be done early or late.
3. The most important thing is to be rich, I think. Once we are rich enough to afford the books or DVDs, it is not necessary to wish everthing for free any more.
The process of forming intellectual property is so harsh that the individual wisdom and fruits of labor are needed to be respected and protected completely.Since joining the World Trade Organization,China has amended its intellectual property rights and strengthened its related laws.However,the education of intellectual property hasn’t caught up with the laws.How many people can speak out the clear definition of IP?If your IP were infracted,how to recover the loss under the protection of the laws?Once the existence of consciousness of IP protection,whatever for individual or certain group,we may expect those tragedy can be avoided.The related regulations and courses are requested to be supported and implemented mutually.
The situation of IP protection in China is not good enough now. The laws of IP protection in China need improved and the consciousness of Chinese about IP protection need strengthened too.
There is something we have to do to improve this situation. There is two way to solve this problem, through education or through enforcement action. In my opinion, education is better than enforcement action. But we could both take the two methods synthetically. By the education mostly and the enforcement action secondarily. The education should include laws education and moral education, and they are both important to solve this problem. In this way, we could expect a bright future though there is a long road to go through.
Nowadays more and more people take attention to the IP protection, as IP now plays the more important role in our lives and for our country. Although China has done many about IP protection, this problem hasn’t been solved completely. Here are some of my advices. Firstly, more and more laws about IP protection should be established. By the way, China does it well and China has a complete law enforcement system for intellectual property protection. Foremost, we should emphases that we should tell people about IP protection when they are babies, and make people know this idea deeply. Finally, we have to improve our consciousness about protecting our intellectual property. And I think it is the best way to protect IP.
This is a topic about the importance of Intellectual Property protection and how to protect private ownership of intellectual property in China today. As we all know that IP can make a great benefit to us not only in money but also could produce social values in somehow.
China is a developing country and also a nation whose legal system is far from perfect just like a newborn infant who has a lot of things to learn during the experience of her growing. Were copyrights non-existent in China? NO. Because of China’s basic national conditions,most of people in China were still unconscious of the importance of IP, and if they copy something or read something that without the authority of the author, it means that they are stealing but they don’t know this. The traditional attitudes toward the copyright law were not strong enough. So we need to strengthen legislation and law enforcement work,meanwhile,we should also make efforts to improve our IP protection law’s promulgation and education. Especially in schools and Universities.
In fact, Chinese government has made a lot of efforts about IP protection in recent years. But because of some historical reasons, china began work on its IP protection system at a comparatively late date. So as it is said from the article, many Chinese people do not pay attention to the fact that taking IP without compensation is wrong.
According to the current situation of IP protection in China, I have some plans as follows:
Firstly, I think it is very important to enhance publicity of IP protection in China because IP protection is a new concept for Chinese people. Some kinds of TV program or advertisement should be made to introduce the knowledge of IP protection, especially the law knowledge.
Secondly, education is also importance. We should educate the next generation and bring up their awareness about IP protection. And at the same time, the law about it should be improved.
Thirdly, maybe technology is an important part. Nowadays, there are many technologies such as Digital Signature, Digital Certificate, and Digital Watermarking, to protect IP from being stolen in the Internet. So, I think it is useful to popularize those technologies.
There are two ways to manage people’s behaviors, law and moral. If we want to stop someone from stealing or grabbing intellectual properties, we should use these two tools. As Jiang Ze min said, govern the country with law and govern the country will moral.
First, complete laws about intellectual properties protection. Laws are the basic principles citizens should follow. To protect IP, we should let citizens know what could do and what could not do with IP.
Second, broadcast and educate citizen laws on IP, tell them what they will be given if they break the laws. Hidden laws lead to criminal.
Third, enforce the executives of laws on IP. Laws are nothing without executives. In long term, morel is a more useful way, but not in short time. That’s why I put the law first.
Forth, enforce the education of IP. In schools, in communities, in factories and other organizations, organize discussion about IP, what is IP, why we recognize IP as a form of property, and why we should protect IP as protect a solid property?
My hometown is zhejiang province ,during the 80’s ,lots of people created false impressions in wenzhou ,and most chinese people know it . In nowadays ,my hometown’s economys is largely developed by the small- and medium-sized enterprises ,the status of fake production is not so universal as before ,but the problem is not solved by far .IP protection in china is still a big problem ,and need to take a long process to complete the ip protection system .
I think ,most of chinese people are lack of legal awareness .They even don’t know that fake production is illegal .Some knows the law of ip ,also keep creating false production .In that case ,the government should carry out effective motions and made the fake production company take severe punishment , as fine a large number of money .The government also can encourage people to report the case of creating false impressions going with some rewardings .The most important thing should be done is to educate our next generation of the ip protection .
I think there is two main points in protection of IP.
First, perfect the law, as specifying it in more aspects.
Second, is the most important, how to carry it out. As we all know, if the government indeed enforces it, many people will violate it by downloading the mp3 or movie on the internet, photocopying the entire books. To avoid something that many persons are sent into prison, the government can give a second chance to the person who infringe the first time. Then put the emphasis upon hitting the web or server which provides the download. In this way, gradually the citizen can keep the mind of IP protection and obey the law rigidly.
Until now, few of us can realize that the theft of other’s Intellectual Property is a serious problem. Why? Because as we grow up, no one tell us it’s wrong. They just tell us not to steal goods from the store. Childhood is a new beginning of education. Right here is the start of a bright tomorrow. So firstly we should teach our pupils about the IP knowledge. When they grow up, they would have the subconscious of the IP right. Secondly our government should make the IP law more perfect certainly. Also we can encourage people to disclose the culprit who steals other’s IP. So that our Intellectual Property may be safer. Thirdly we must punish the IP theft strictly, just like execute one as a warning to others. But most important we should protect IP right of ourselves carefully.
Although the Chinense government has made it’s efforts to protect intellectual property,you could find illegally copied books,CDs everwhere in China.So protection of IP must be paid more attention to.It is observable the Chinense government has much work to do in it’s legal system.But the more essencial problem is that the grovenment must make the people know that stealing IP is as serious as stealing in a supermarket.Many Chinese even know not there are laws about IP protection.They believe it is OK to download the resoueces in the internet without paying money.So the grovenment should give publicity to IP protection .
I think that I could understand the reason why Chinese have weak consciousness about the IP protection. I think Chinese people see the intellectual product as “one person” who has its own thought and consciousness. It means that one could see that the intellectual product is created or “borne” by him, but he couldn’t have a thought to control it. But the world is changing and people’s notions are also changing, nowadays people prefer to protect the Intellectual Propertity. And I think that if necessary, China will do better in the IP protection as the Occident do.
In my opinion ,the IP of ourselves are very important for our future. In modern world , the IP is the most important fact to compete with others. We could not only make money from it,but to change our life.I think that there are there ways to protect our IP.The first is to protect IP right of ourselves carefully.Some IP we could not tell anyone else,we can make it ture by ourselves.The second is to make the IP law more perfect certainly.IP protection in china is still a big problem ,and need to take a long process to complete the ip protection system.The last but the most important is teaching our pupils about the IP knowledge.And teach them to make the sense of IP protection.
As we all know that IP is important,but not much ones know enough of IP.As to Protect IP,wo must do a lot of things. First we must learn much about Intellectual Property ,and make enough IP theory and learn the important of it.Second we have to make enough law to ptotect IP.Third,we must use a great number of method to teach people about IP,they must know what is IP and the importance of it.Fourth,we must punish the one who break the law of IP.At last,the goverment should encourage people to create more IP.
If we want to keep improving our productivity pace, one thing we have to do is protecting intellectual property as soon as possible in order to promote the creative enthusiasm of people. So individual, government and social organization should take active measures to protect IP. Firstly, government has to formulate laws on IP to deter the crimes of IP. Secondly, individual is respected to be aware of IP protection and learn how to protect his / her IP effectively. Last but not the least, social organization on IP protection also has to advocate the IP protection to make the public beware of the importance of IP protection.
IP is something that we should take serious. If there is any harm to IP protection , there will be no good ideas , no good books ,no good movies for us to enjoy; If there is no good ideas to share ,there will be no progress in our society. It is a pity that China have done an insufficient job on this field . But we are glad to see that China have made great effort to improve it better.Laws have been worked out ;The awareness of the IP protection of our people have been promoted. We belived that, in the near future , there will be a great change of the protection of IP in China.
Here are several advices for the CCP.First,The Government should set up some policies to
promote the IP protection of the enterprises ,thus make the enterprises act up fairly,make
all of them respect the IP protection.Second,the law should be set up that if someone
infringes others’ IP must be punished,and the government should strenghth to fight agaist
piracy.Other laws for perfecting the IP protection should be set up too.Third,
the IP protection should be given publicity to the society ,especilly to the youth who will take
control of this country in the future,in this way,most of us will realise the importance of
the IP protection.
With the advent of information society and knowledge-based economy, the intellectual property system plays an increasingly important role in promoting economic development, scientific and technological progress and cultural prosperity. For five thousand years the Chinese have had no concept of private intellectual property rights .It is a tough task of teaching the whole society about the value of private ownership of intellectual property. This educational process must begin at universities. Organize volunteer association to allow them putting up posters in schools, streets and other public places. In the railway station, waiting room we can put some magazine to educate people. For those who are illiterate, we can use language and pictures to educate, and then let the whole community understand the act of taking without compensation constitutes a theft.
