Best IP  Protection is Through Education, Not More Enforcement Actions

Introduction

It is beyond dispute that China has some of the most comprehensive and up-to-date Intellectual Property (IP) protection laws of any country in the modern world, in conformance with its accession to the Berne Convention and the Geneva Convention.1 This is a direct result of China’s serious fourteen-year pursuit of World Trade Organization membership and compliance with its WTO obligations.2

On October 27, 2001, China promulgated the amendment to its PRC, Copyright Law of 1990 (the Copyright Law). The amendment came into effect upon its promulgation. The purpose of this amendment was to bring China’s copyright protection to full compliance with relevant international conventions. It seems more than coincidental that the amendment was promulgated one week before China signed its WTO accession documents; the amendment was issued in all likelihood to prove that China is making efforts to honour its WTO commitments.”3

China acknowledges that its own IT sector is retarded due to lack of transfer of foreign technology and lack of foreign investment, both caused by lack of foreigners’ belief in IP protection in China.4 China has ratcheted up IP enforcement with record numbers of prosecutions in all provinces and semi-autonomous regions, because China sees this as being in its own economic best interests. Yet, organizations like AmCham assert that while such enforcement actions are laudable, they fall far short and suggest that the situation is getting worse, not better.5 The Asia-Pacific Council of American Chambers of Commerce asserts, “Aggressive enforcement of intellectual property rights will benefit both consumers and businesses. Encouraging the enforcement of IPR rights will allow U.S. companies to reap the benefits of their investments, and will also encourage additional businesses, particularly small- and medium-sized enterprises, to participate in the global marketplace.”6

This myopic world-view taken from a “business only” perspective ignores the most fundamental principles of Globalization, cultural diversity appreciation and understanding. For five thousand years the Chinese have had no concept of private intellectual property rights. Under the Emperor Dynasties and more recently the Socialist Economic System, the government owns all real and personal property, including celebrity endorsements.7

1.3 billion people cannot be expected to embrace such a foreign concept over night. IP protection is brand new (last 20 years) and the basic change in recognizing private ownership of IP is hard to teach and hard to accept. Only 53 percent of the people even speak Mandarin8 and more than 8.72 percent are illiterate.9 That is one-hundred thirteen million illiterates in China. An entire society needs to be taught about the value of private ownership of intellectual property. This educational process must begin at China’s universities where libraries allow and even encourage wholesale copying of entire books.

Under the socialist economic system the government owned the books (copyrights were non-existent) and the people are the government. So, the people copy what they already own and thus are not stealing anything from anyone. This practice continues to this day. Chinese libraries still allow this practice to continue unabated without even a cursory check to see if the book has an ISBN number.The Chinese universities are the Research and Development labs for China and yet 75 percent of them fail to patent their own inventions.10 India is as adept at copying China’s non-patented pharmaceuticals as China is at copying America’s copyrighted DVDs.11

Chinese people understand that it is wrong to steal tangible goods but there is no concept that taking IP without compensation is wrong. Intangible thoughts and ideas have no reality as something that is subject to theft, even when they are reduced to a writing or artwork. On any given day, in any given Chinese bookstore, there are more people sitting on the bare floor stealing IP (reading books for free) than patrons in the local library. Even the bookstores encourage IP theft. There are no signs prohibiting free reading and no enforcement of such a “foreign” idea. The people know that they cannot take the book out of the store without paying for it, but they do not understand that their act of reading it without compensation also constitutes a theft. A major Shanghai university teaches IP protection using a Prentice Hall book, copied in violation of the copyright laws. This university has a teacher stand in front of the class and teach that it is wrong to steal IP while teaching from a stolen textbook. This is hypocritical and sends the wrong message to the students who are the next generation of business and government leaders. The universities must teach, not just preach, IP protection and they must implement what they teach. China’s universities are teaching the next generation of political and business leaders, as well as the next generation of teachers. Education is the fundamental key to change, not enhanced enforcement actions.

Increasing IP enforcement actions tenfold will not accomplish the desired transformation of Chinese thinking and attitude towards IP ownership and protection. This can only be accomplished through proper education, not hypocritical half-hearted educational efforts. It is no easy task to bring such fundamental change to the thinking of 1.3 billion Chinese people. It requires a psychological revolution of unprecedented proportions to create a new ethos where none has existed before. Enforcement actions undoubtedly have an effect on those successfully prosecuted but to assume a deterrent effect that will sweep throughout China’s society is to continue to believe that capital punishment deters murder or other serious crimes.

    Nowadays, intellectual protection is increasingly pushed on the calendar. Obviously, people in various lines of work such as economists and sociologists and so on all expressed enormous interesting on this hot issue. Yet we have to admit there is a great step to stride at present in order to implement intellectual protection in action.
    In the current society of China, some people maybe regard that the intellectual protection is a double-edged sword. That is simple to conceive because if we protect individual IP we cannot to do many things such as reading free books from library and downloading songs from internet. What’s more, we could not buy those bargains which copy from certified products. How foolish it is, indeed, if we pursue intellectual protection in shooting speed we will bear some risks and endure a great loss at present, however, if we assume in a far way, we will be paid for a brilliant future, moreover, we will establish trust and credit in the international society again.
    By the way, how can we take the intellectual protection into action? I think the fundamental point is to vary the view of people. Most people ignore the intellectual protection, and the reason is that they don’t know their behaviors are illegal, and this process is not immediately putted into practice. We should be careful and much patient for the reformation, then, we should highlight the importance of education so as to improve people’s sense. Through proper education, not the hypocritical half-hearted education we can change our minds for IP gradually. Only in this way can our country develop more strong and have a splendid future.

    There is so many IPR problems in china, especially in town. Make my hometown for example, there are so many middle or small company don’t care the Trademark much. How to make the people to know the importance of that is a big problem. Here is some of my opinion.
    We should let them know the law, so the first thing we have to do is to teach them the law. To organize lessons to some middle or small businessman. Maybe they are deeply know the business rule of the market, but they don’t treat as a juridical person before. So after the lesson, we should let them to log their trademark in the administrative department of industry and commerce. The government should give some interests to them, like duty reduction, or provide them some help from technology. Only these can encourage them put attention on the law, but it’s not the key point. If you have problem that it will cost much, but you should know that there are so many companies which doesn’t log in the government in the town. After the buffer period, government should carry out the law seriously. Maybe some corps will be replaced, but the market will be more orderly. And the government can help some companies that is potential to go out. I think it will at least need 3 years to realize the target. But it help much to create the market economic.
    It’s only my immature opinion, hope it can work.

    Aim at the situation of “IP Protection” of China in this years, I think that there are some methods to solve the problem:
    1. Put the “IP Protection” into economic law and other relative laws and implement with a firm hand.
    2. With the develop of economy, business demand “IP Protection” a fortiori. Our governmen should establish a section to administer “IP Protection” in the filiation of economic deparment.
    3. Teach students at junior or senior high school that make more and more people know about “IP Protection”.
    4. Use the media like newspaper and TV to popularize the concept of “IP Protection”.

    First, the government should set up a sound legal system for IP.
    Second, we should enforce the law strictly.
    Third, promulgate the important of IP.
    I think only we have the corresponding law and enforce the law. We can punish the corresponding action. Then, more and more people will aware that what is IP, which action is wrong and the important of protecting IP. But we need a long time to do this. And maybe many people can’t understand about it at the beginning time. So we must enforce the law strictly and promulgate the important of IP. Only in this way, we can protect IP. I know that t is difficult to do everything. But if we don’t take action, there will be no good art, no good book, and no good music in the future. Our country economy will be affected by this.

    I do believe Chinese government will take some actions to carry out the IP protection law someday,but in current situation I don’t think it is appropriate to do so now.I agree with Martin and also I’ve seen my schoolmates’ suggestions on how to strengthen our awareness and how to punish the IP “thief”.Well,let’s imagine:from now on I can’t download any music or movies from the website freely,I can’t read any novels freely because that is all illegal.If I have enough money to pay for each of them,that’s easy,no problem.But what I am concerned is that:to the citizens who are very poor,they just can make a simplest living,how can they afford their culture life?If they want to watch a movie,they can go nowhere but only the cinema,but you know the price.If the government can do a package deal,I mean China already has the ability to provide her people the resource to share fairly,regardless the poor or the rich,is it still a problem?China still has a long way to go judging by its current economic situation.We all know IP protection is a hard task to be achieved,but before we take actions,we first must make sure how to charge the fee so that everyone can share the resource fairly.I really don’t want to see some people who may have no chance to enjoy something because of lacking of extra money.To the rich,anything is easy to get by paying the price,but to the poor,how can they get that?I do know nothing in this world is free,but what I am more concerned about is the world is making a big progress besides making profit.

    Honestly,I have not realized the phenomena of IP violation is so serious from the companies to the schools in China.Maybe the original reason of that is the traditional thinking of Chinese people.Although the government has made a lot of measures to promote the IP protection,it is still a long way to go.China is a developing country and of vast territory.As we know,there are different cultures and different economic levels among the 56 nations.What can we do to let the large number of people to be aware of the importance of IP right?The answer is definely education.     I never thought we are guilty when we download the music from Internet before I attend the oral English class yesterday. But in China billions of people lack of the awareness of IP protection like me and the problem of IP protection has slow down our country’s economic development. In order to solve it, the most important thing to do is publicizing the knowledge of IP protection especially among the younger generation. Schools should educate the students to respect others’ creativity and protect our IP right from being harmed. But there will still be some people continue this kind of action.     Today in our life, IP became more and more important. We all know that no work no development ,no create no progress. I know a story about IP. In my little sister’s high school, there is a teacher who teach politics. When he study here, once his mentor ask him to write a thesis, then he finished the thesis and hand in his homework to his mentor. The mentor said it is so bad. At the beginning he think his thesis is really bad, but he found his thesis was published in a magazine after some time. And the author is his mentor. So he is very angry, then he leaved his school. He think he is only a student but his mentor is a professor, so no one would believe him.
    This phenomenon is not the unique, and IP is not perfect in China. Maybe we will meet this case, so we should strengthen the protection of the law and protection awareness. The best protection of IP is through education.

    If I am the advisor to the CCP.I would suggest the Government enact specific laws to protect intellectual property. This is a more effective method in the short term.But the most useful way is to educate.

    In my opinion, we should first make the students know the IPR through teaching them the knowledge about IPR.     Since the reform and opening policy, China has accelerated the process of establishing an IPR protection system in order to rapidly develop the social productive forces. But IPR protection system still has some defects. Here are my plans to perfect it.
    In China, some 5 years old children have already know how to use computer. They down load network resources for free and don’t feel guilty of their behavior because their parents do in this way. So I think, we should offer a class to the little children on IPR in a simple and easy way, in order to let them know at an early age that we should respect other persons’ innovation, and don’t copy from others. Education on IPR should be offered in college, too.
    We should launch a television program about IPR on CCTV, for CCTV is the most famous television channel in China. In this way, huge amounts of people, especially the businessman who has the greatest potential to break the IP law in their business life, in China will know more about IPR protection, then, it will be easier for the government to administer the IP law.
    We should also set up a legal organization to enforce IP law and make it perfect according the development of our society, that is to say, to ensure IP law advancing with the times.
    We should have faith in that under the efforts of all comrades in China, IP law will become much more perfect, and more and more new things will emerge under the protection of IP law.

    As we know that the IP protection should be taken seriously. But how can we do to protect it?
    We should aware that there would be at least two sides of the IP protection. One is for the individual and another for the society.
    So that my plan to solve the problem can be concluded as follows:
    Firstly as the owner of the intellectual property, one should learn to know how to protect yourself and protect your property. Keep the evidence to proof you are the owner of the IP.
    Secondly the society should do a lot of things to protect it, including the university education, social communication also should be done to let most people get to know something about IP.
    The government plays an important role to make sure that private property should be protect well. In order to accomplish those things, the legal system improving is indispensable. The punishment also should be done when the crime happens.
    Though these things may cost a long time to achieve, we should be patient for that.

    Frankly speaking, everyone knows that IP is important, and it’s wrong to steal others’ achievement. But if you want to change this situation in china in a short period, it’s, I think, impossible. China is a development country. Compare with west countries and Japan, China doesn’t have many resources to pay for the copyright and patent. Maybe you will feel it’s unbelievable. But the fact is, to a country that many people still live a hard live, how you should ask the people to pay something that seems has nothing to do with them. Of course, this situation would change, but not today or tomorrow. Only when the economic becomes better and people needn’t to work for a simple live, can people pay more attention to the IP. And at that time, the IP protection wouldn’t be a problem any more.

    It’s known that the phenomenon of stealing intellectual property is very common in our country, and we can see lots of piracy DVD, VCD, pirated copy books and so on everywhere. In my opinion, I think the most important part to resolve the issue is to improve people’s awareness of IP, for many people ignore IP even never know the concept of IP, according this we can take measures form several angles, one, for the education, teachers should teach students about IP. Two, for the government, it can point the importance of protecting IP and step up propaganda efforts through media, such as TV, newspapers. Another important part to resolve the issue I think is to regulate the market, which mainly is regulated by the government, it can draw up a series of laws to regulate those who steel IP, of course, as citizens who clearly know IP, we also should restrict ourselves not to buy anything of illegal copy.     Intellectual property right piracy in China effectively destroys the creative initiative of Chinese inventors and scientists. It also hurt the bilateral relations with many countries. Therefore, IP protection is becoming the most challenging and significant issue.
    What can we do to solve the problem? In my opinion, we should provide an environment which is safe for intellectual property right. It can be divided into three parts: market, punishment and education. Let me explain the first part with an example. In 1998, a piece of win98-cd was sold for 1998rmb. At that time, ordinary earn about 500 hundred a month. They have to eat, pay the rent and so on. And there are many copies sold 5rmb a piece. It is not difficult for most people to make the choice. When the price is up high in an unacceptable way, stealing happens. If we reduced 1998 to 50 or so and provided more service than the pirates do, maybe they will lose the market and disappear because it is unprofitable. And this won’t need any police or law. The second part is punishment. When the cost of infringing is very low, people won’t be afraid to break the law. Years ago, the punishment of traffic violation is up to seven years in prison even if you drive after drinking and kill five people. But lately a man who droved after drinking and killed five people is sentenced to death. By now, the drinking problem has been under control. It seems to be effective to increase the punishment. For the last part, better education should be provided to let the citizens, not only the students, know about the laws of IP protection. People are not stopping breaking the law when they don’t even know they are breaking it. Establishing such environment above may do a little help to IP protection.

    During the class discussion,I was shocked that so many student took it for granted that downloading music,video and so on for free on Internet is legal.In our neighbour city Hongkong,the government had already forbidden the download software like BT(bittorrent,a kind of P2P download software),and the music download cannot be free.
    So,too many people know little about the IP protection.So here is the first suggestion:The IP protect concept should be gernally educated.For example,we can set up a certain compulsory course about IP protection in senior school or junior school so that the teenagers will get the IP protection concept.
    Second,most of us have PC,and almost everyone’s operating system is “Windows”.The price of this software is about 2000 yuan, nearly a middle class’s one-month salary.If we take “Office”,”Photoshop” and so on software into account,it can be a huge cost for a person.So here I recommend that these software companies may publish a special version that is not so expensive for Chinese users.
    The third one is that,there are so many exellent textbooks we can’t get in China.So if we have to read it,we have no choice but only to get the photocopy.So the government may encourage the chinese publishers to publish these books.
    The last but the most important is,the IP protection law should be completed.

While, considering the complicated realities of China, consciousness of protecting intellectual property are not strong on the whole, particularly little consciousness in the areas that are sharply short of education.
